Is this fair?

Hi guys. I need some input on this situation at work. I'm not sure what the guys problem is but he hates me. Anyway, the last time I was at work he verbally attacked me and threw a wet dish rag at me violently. I'm usually a fighter but since I was at work I figured I shouldn't risk it. So I called the police and filed a report for harassment. The police say I should go before the magistrate and swear out a warrant for him. They want me to swear out a warrant for him because he had an issue with another employee and he followed him home and harassed him. I was going to swear out the warrant for his arrest, but I had a brainstorm. Because he wanted to be bad- at work, I am going to be . Here is the proposal I sent him:
Hi Henry, I wanted to take the time to tell you I am extremely taken off by your actions at work. Today I received a letter from the sheriff stating the police report was put in the system and I can come anytime before the magistrate to swear out the warrant for harassment; which I plan to do. I really don't have time to spare and I don't want to be like that so I have decided to give you two options.
1. Write a 2 page, double spaced, 15 point new times roman letter of apology drafted to Junior and myself postdated by 10/10/08. I can receive this letter at 1******** ave east Tuscaloosa,Al 35404
2. Go to jail.
Thanks for your time, and have a nice day.
So what are you guys thoughts on this? I think it's more than fair.

I can't stop chuckling...how does one throw a dishrag violently?? Was it like a "haymaker"...I mean did he really wind it up
. I would not put so much stock in it...bet if you just went off on him he would stop...He is probably an only child with some kind of developmental problem, and is not used to people returning confrontation. I would have gotten fired that day, as I tend to have a rather short stick. Congrats for keeping a level head.

IMO no letter just file the warrant.
1. The letter does nothing but make you feel better.
2. The letter does nothing but alert him and make him more angry.

I'm male. He already knows where I live. I only decided to ask him to write the letter to belittle him. He is a 39 yr old x-marine college student. I know he dont want to go to jail because the college will be informed and the business fraternity he's in will also.
