I believe what is being argued in this specific case is perfectly legal. They tracked phone usage at a specific time in an area. It isn't like they were listening into the conversations. Damn good police work if you ask me. Just like if you get a hit on the number of a known terrorist overseas.

over 20 years ago the supreme court ruled that wireless phones did require wire tap warrants. some of the same arguments were made then as now.
Now if the president is collecting intelligence as commander in chief in the conduct or war and on the battlefield, no warrant is needed ever. He can listen into any conversation over any device anywhere to collect that intelligence.

The way I understand it is, they aren't listening in but pinging the phone to see where it is located. Or have I missed something?

I believe they pulled phone company records for calls made from towers in certain areas at certain times. As long as they aren't listening to conversations I am not seeing the big deal here as long as they get a warrant to get the person's name associated with the numbers. Not ever sure if they need the warrant for that.

True, the police have pulled call logs but these are not listened to or recorded. It just states a time the call was placed and to what number.
Either way, they are not listening in on a private conversation....

They do listen in if you call or are called by an overseas number tied to a known terrorist. If during that call you admitted to killing Jimmy Hoffa they couldn't use it against you unless you did it as an act of terrorism.

I wouldn't go that far. I don't support sending troops somewhere if he isn't comfortable with using the term victory...
Why send people over there, unless you know we can kick some tail, make it work, then go home...
The simple fact is the Obama administration is arguing that it is ok to find out where you are using government required GPS put into your phone (which last time I checked they still hadn't equipped the majority of the 911 call centers with the technology to utilize it.) Domestic US citizens, without a warrant... But Bush wiretapping international phone calls is worth months and months of feigned outrage...

What about a few months ago when it became known they where tapping and listening to the phone calls made by our service members overseas? I don't remember the exact specifics though I doubt they where overseas numbers tied to known terrorists.
