It is up to the president when an opening for the Chief Justice comes up. He can nominate a sitting justice and then someone to take that person's spot on the court or as in Bushes case just nominate a new chief.

He isn't the newest judge, Alito is. But yeah, the president appointed him to that open seat when Rehnquist resigned.

The senate must confirm the President's nomination. It is not the sole
decision

well, yeah, but they don't sit there and tell the pres who to send their way. Well, they tried.
