The "war on terror" is akin to the "war on drugs" not a "legally declared" war per se, just a term we (rather loosely IMO) use to define our actions.
The Constitution applies to everyone on US soil, citizen or not, the Constitution does not discern between the two when it comes to these protections.

What the LIBERALS are forgetting here is the VERY LARGE picture. We are fighting an ENEMY that was and still is WILLING to take over PLANES full of innocent people and FLY THEM INTO large steel buildings. Who is to say now that the enhanced innteragation has been stopped that the next targets will not be the White House US Capital Sears Tower or God forbid the Super Bowl. But the Liberals in Congress and the Administration think that all is HINKY DORY in the world and refuse to admit that people out there want to kill AMERICANS or would want to see the USA wiped off the MAP. Did they forget about the Cold War I forget they are trying to Convert US TO THE NEW SOVIET UNION WHILE THE SOVIET UNION IS TRYING TO CONVERT TO CAPITALISM.
