The counter argument as I see it here would be that as non-citizens, Constitutional protections do not apply.
FWIW
The "war on terror" is akin to the "war on drugs" not a "legally declared" war per se, just a term we (rather loosely IMO) use to define our actions.
The Constitution applies to everyone on US soil, citizen or not, the Constitution does not discern between the two when it comes to these protections.
