I HATE the "BAY" and Paypal

So here's the back story. I was paid for an item through a BIN and I could not ship for a week do to Christmas and all. I finally ship and obtain a delivery conformation number. A couple days later, I receive a message from the buyer asking if I had a tracking number, mind you this is at night so I decided to look for it the next morning and I would respond back accordingly. That next morning (Today,) I opened up my email and found I had a paypal dispute for something I did not respond to within a day. Today, the buyer also escalated it to a claim.
This really grinds my gears... What are my chances of me getting my money back?

I would give the details to paypal and after the dispute is over you should come out with your money. I've had it happen once over stolen identity. Took a month for the funds to get released through paypal.

If you weren't ready to ship the item you shouldn't have put it up for sale IMO.
If I were your buyer I would have done the same thing.

Really? If you were the buyer in my case, you would just file a claim without even communicating?

True but if you have an e store and they do a BIN it really sucks to close it for the christmas week and reopen it again.

You didn't send him the delivery confirmation the day you shipped, he asked for it a couple days later but you decided to wait to respond.
It seems to me that he wasn't the person not communicating.
Sorry, that's how I see it.

Then ship it Christmas week, why is that a problem?
Or at minimum state in your ad the exact date the item will ship.

I see we don't agree on some things. I get the delivery conformation for myself, in case the buyer claims he has not received it. The buyer also did not buy a delivery conformation.

I agree with 100% Bang. Maybe if you had kept the buyer informed of any delays they might have been understanding.

I primarily only sell on the "bay", but if I receive payment, I have always shipped within 24 hours....But you are right, they should have communicated with you prior to filing a claim.

Ok, that's a little different. Did you take a loss on the shipping?
 
If you did not tell the buyer you could not ship for a week, I would have done the same thing. There are way to many scam artists on there. In no way am I saying that you are one, but you have to protect yourself. I do lots of business on the BAY, and usually shipping information is very clear or I ask befor buying.

some people are a little nuts. Typically this can be resolved by shipping. I'd imagine, unless otherwise stated somewhere that if you've shipped the item. Within a few days. you aren't going to lose the case. Just send paypal the tracking number and say it is shipped. This just a dispute or already made as a claim? Because as dispute just means that paypal has an "email" type system and opens it for communication between the two parties.
Recently I had a guy I'd shipped something to. Well anyways it broke according to him. So I said that is fine that is what we paid the insurance for. Well anyway the fedex people ticked him off. He started by telling me ethat the fedex had the item and was sending me the $$. I said no problem I'll send you the money when I get the check. Then it turned out that he still had it. We went round and round. I told him I'd be happy to refund the money. But I needed the item back. he wanted me to give him the $$ upfront. Somewhere in all that he threatened to file a dispute and then filed it in the 8 hours I was at work and not bothering with it.
But that being said, just send him an email with the tracking information on it. If it is already sent. And tell him politely to get lost. Personally you should have taken the 5 minutes to let him know. Some people just need to understand that no one is perfect, and this isn't your profession (as least I'm assuming) and other stuff gets in the way. After 5 years of retail, you'll learn that you can give some people the moon and they'll still be ungrateful little *insert choice word of preference here*.

I see both, bang and major side.
I sell a lot of frags and hess trucks on the bay and I write every detail about the product and shipping. Tracking numbers and insurance are also at the buyers expense. I always get a tracking number, insurance and signature confirmation for my own protection. Knock on wood, only had one problem with a buyer who was not home at delivery and then did not pick up the package and the frag ended up dying later. Buyer tried to dispute the original cost, once PP and bay read the auction it and the agreement about first attempt and the emails between me and the buyer about shipping date and the buyers availability to be home and take owner ship and all the documents the dispute was waved in my favor. I also upgraded to the premier account with PP as to ward off any dirty buyers tricks.
As a seller you need to keep records of everything and break you’re a-- to make sure you do everything you can to keep the buyers happy.
If your in the right with documentation and tracking copy and paste it to the respond page on the dispute and pp investigators will look into it.

Don't sell if you can't ship. That simple. Also, you should feel bad spending this guys money when what he bought isn't even in the mail.
And in my opinion, "Christmas" is no excuse. What does that mean anyway? Does that mean you don't want to wait in the lines at the post office?
