Ripped off on ----. Any advice??

Ok. I hate ---- now!!!!!! I was looking into buying a motercycle. I wanted an old used one for my first so if I wrecked it I wouldn't beat myself up. I found one I thought looked good and wasn't to expensive. The guy told me it only needed a stator and just had a new paint job a few years ago. Great bike and runs great otherwise. I purchase a 1989 Kawasaki Vulcan for $1226.00. The guy works for the military and said he was going to be out that weekend but I could get it Tue. when he gets back in town. I agree and pay for the bike via credit card through pay pal. I can't get ahold of the guy the day before pickup to get his address. Finaly the day I am supposed to pick it up I get ahold of his wife and she tells me that is a bad day to come and get it and the guy sais that it developed a fuel leak but he will fix it. I am supposed to pick it up the following Fri. Friday morning he e-mails me and tells me he can't wait to meet me and he will mail me the tital. NO NO. No tital I want my money back. Oh sorry my wife didn't send it off yet so I have it. I go to pick the bike up. It is wrecked!!!!!
The whole side scraped up, a mirror missing and the fuel problem not fixed. It gets loaded onto the trailer and taken to a shop. It has engin problems, transmission problems, clutch problems, and about $1000 more damage that just stated on it not inclusing what it costs to have the body fixed. I file a claim with ----'s auction insurance. They don't cover everything just engin and transmission problems and the $ amount isn't enough for them to mess with so they say sorry ---- can't help you you got scammed. I file with my credit card. Pay pal is charging him back and reqesting he come pick the bike up. he e-mails me that he dosn't want it. What can I do if pay pal falls through.

Save all correspondences with the guy. Try to get him on the phone and to admit anything and tape it, it is legal as long as one party knows it's being taped. File a small claim. Bug the CRAP out of paypal.

Not sure what all you can do now except those things as stated above. Good advise there. Just wondering.... what kind of feedback did this guy have? The mafia thing would probably be the best route!

I am so mad to the brim with this stuff. I may look into the mafia thing!!! The guy admitted to the e bay rep. that he ripped me off and said now it is her problem. The guy had a 90% rating and the neg. feedback he did have way him being the buyer not the seller and he claimed people did the same thing to him that he did to me. He won't answer my phone calls now and he put me as spam on all his e-mail addresses so I cannot contact him but I do have all the e-mails that state the bike is in good shape and his promises to fix the fuel leak. I also have disputed it with my credit card and they went to pay pal.

1. did the auction description say it was wrecked?
2. if it did not say that, then why did you take receipt of it? you should have refused and demanded a refund on the spot. then, you would probably have a stronger case if he didn't give you the money back.

Thanks. I know I totaly messed up by picking it up. I was told by some crack pot lawyer that "you don't want him to have your bike and money both" Then the lawyer I realy wanted to talk to told me oh why did you do that you should have left the darn thing in the driveway. Now I wish I would have left it. Do you know where scubadoo mainly hangs out on the message boards?

I want to chime in my .02 cents here. I was reading another post you started about your water being brown....and you mention that you don't have any money since your husband was in a motorcycle wreck, but you're buying another bike? I was told years ago that I need enough money to live 2 years at my lifestyle without working....you may want to think about your life choices.

This you are correct. My husband was in an accident as was I. I purchased this motorcycle about a month before the accidents happened. We are living off of our savings but do not have enough live on for 2 years. No I am not making any large purchases due to the no work factor.

I would however like to get my money back from this jerk who scammed me and this would help us out greatly with our savings and in getting my water problem solved in my sw tank.

Just an FYI i wasn't trying to be a jerk, but I rode bikes for years, got a trail ct70 when I was 5 years old, then a xr80, cr80 , kx 125 and at 16 bought a ninja zx6r , and had over 12 cafe style bikes since, I would consider myself a awesome rider, took ABATE and was a pro stunt rider...at all times I wore a Dot & snell approved helmet and either my Vanson or Joe Rocket Leathers....anyways I have seen lots of people hurt and killed, I admit some brought it on themselves, but often times it was people in cars not paying attention...Finally I realized how stupid riding a motorcycle was....I gave up riding in 2002 when I saw a woman in a car, hit a trike, amputate a womans leg below the knee...the woman in her lexus suv got outta her car still talking on her cell phone and continued talking on it until the police showed up...she said it was important business...Thats when I sold my good bikes, my wrecked stunt bikes and said no more...my life is way to valuable...you want the wind blowing through your hair...but a convertible!

Small claims could work, BUT the claim would have to be made where you MADE the purchase, so if it is in another state have fun traveling

I am sorry to hear about your friend. it realy stinks with people not paying attention. I bought another bike after my scam (before the accidents) and was learning to ride my first bike. My back tire compleatly blew on the interstate and I wrecked. My husband gets up early like 3am to go to work. It was that early on the 5th of July and we live in bfe with deer everywhere. The fire works had scared the deer up and it ran out in front of my husband and caused him to wreck. The tore the rotor cuff in his shoulder. Thankfully he lives in my state so that was the only smart decision I made. He only lives one hour from me.
