The contraband comment...interesting. Ok, let's try this, a mom smuggles drugs in a baby's diaper. Is the baby a criminal as well in this instance? If so, explain. If not, how is this different than the baby being born?
I would say yes. The drugs were in the possession of the baby, not the mother. The mother would be an accessory to the crime. You can't consider the baby 'luggage', just because the drugs were hidden in the baby's 'clothing'. Don't think you can compare this to an unborn child. The baby, even though it is not legally able to take care of itself, it still a individual human being that isn't being carried across the border inside its mother's womb.

I don't know about that. I have seen on TV may times where cops find drugs and guns in infants cribs with the baby sleep but charge the parents not the infant.
