I would say yes. The drugs were in the possession of the baby, not the mother. The mother would be an accessory to the crime. You can't consider the baby 'luggage', just because the drugs were hidden in the baby's 'clothing'. Don't think you can compare this to an unborn child. The baby, even though it is not legally able to take care of itself, it still a individual human being that isn't being carried across the border inside its mother's womb.
