Wrecked my new car---need to vent

Hey guys, don't know if you remember when I posted about 3 weeks ago about buying a new Saturn Ion 2 or not, but just figured I would share my greif here..... I wrecked it

Since the remains of the hurricane came up through PA had problems with flooding. It's all so ironic though. I spend 4 hours friday evening trying to stop cars on a 4 lane highway from driving into flood waters that came up onto the road. I also pushed 3 cars out of the water. Sunday night I came home from being at my g/f's for the weekend and decided I was going to see if I could make it to work (started a new job on monday). There was a road closed sign ahead right before a road that goes around the head of a mountain that is pretty much a big cliff. Thinking that the rocks probably fell onto the road from water I went up over the mountain via a dirt road... pretty much a trail. Car made it fine and I didn't see anything wrong with the road so I started heading towards the place i was going to work. I was glancing at my speedo because the cops sit in that area and the nex thing i know there is this big white thing in front of me. I slammed my brakes on and locked up all my tires (didn't get the anti-lock brakes) and see all these little white things fly all over the place as a big thing flys up overtop my car. I pulled into the parking lot and got out swearing and yelling.
Looked at what I hit and here it was a barrier that was in the road. This is like 5 MILES away from the road closed ahead sign. Look over in the parking lot next door and there is a motorcycle making his way over. He asks if I'm ok and I was like "yea, except I bought the car three weeks ago and did the first oil change on it today.... I'm really angry and this sucks". He's like I know, I squeeled my tires and almost hit the barricade too. We talked and he gave me his name and phone number in case it would help me at all for insurance and what not.
So I get in my car with a dented hood and scuffed bumper and the likes and drive to the nearest gas station. I call the police and they refuse to right me a report saying that there were no lights or anything on the barrier saying because I left the seen (didn't have a cell phone what could I do). They said they can send a trooper, but if he wanted he would give me a ticket for passing a barricade. Oh YAY! So I thanked them for nothing and went hom got the camera and went back to the scene and took pictures of the barricade and my skid marks on the road. Did research on the internet and found the regulations for setting up a barricade. According to PA law it has to have a minimum of 270 sq inces of retroreflective tape and since it was a type I barricade and it was nighttime it needed to have a blinking light fixture on it, which it had no light and no reflective tape. Also, the colors are to be white base with orange stripes at a 45 degree. The barricade was white with black stripes and it was done with a paintbrush wit normal household paint. The law also says if it is for overnight it is to be a type III barricade which it was not. So not only did they not use the right barricade they set up the wrong one incorrectly.
So I call my insurance and they were impressed with my research and were very pleased that I took pictures of the barricade. They gave me two options, pursue it myself or have them pursue penndot for me. I am choosing the first because if I fail they will still attempt as a last resort. So I called up my local counties penndot and got transferred 3 times till i got this one guy. I told him that I ran into a barrier and would like to file a complaint saying I looked up the laws and it did not meet regulation. He asked if I had a police report and I told him no because they wouldn't give me one. He's like well unless you have a police report I WILL NOT file a complaint. So I was like "OK thank you so much sir" just to be an ass and hugn up.... called the state police and they said they would send someone down, but he would probably not fill out a report for me. Anyways I waited at work and the cop didn't show up, and eventually left me a message saying I can go to a state police station and get a report filled out and the number I needed. So when I get off my second job 12AM I'll drive to the one closest to my home about and hour to and hour and a half from work 30 minutes from home and ask them to fill it out since there are cops there 24/7. If they won't give me a report I don't know what to do. The only thing I can think of is call back to penndot and if they refuse to fill out a report I'll tell them that i'll see them in small claims court then. It sucks because the barrier was totally unexpected and it wasn't even lit up. It was just sitting there in the middle of the road. UGH... guess this is what I guess for buying a brand new car. Should stuck with the crappy one I hated so that I could just laugh and be like "that sucks"

PS Sorry for the long post, but if you guys have any suggestions it would be greatly appreciated as I have never sued nor wanted to sue anybody, but I can't afford my deductible or for my insurance to go up a penny. Crappy part is even if I get them to pay for it, insurance said it willl most likely take months.

NEWS!! Call one of those action news stations. They would prolly like nothing more than to go up against the law itself. You got pics so if they change the atmosphere around the barrier (i.e. add lights, reflective tape etc...) then that proves they were listening, just to lazy to do anything. But if you aren't on record with somebody soon, you may get nothing.

Barriers gone... it was gone the next morning when I went to work. The flooding went away I guess. I'm going to stop by police tonight, if they do nothing i'm going to call the district justice and possibly go the the legislator. This isn't going unheard. I just bought the car and this took all the enjoyment out of having it. I used to feel like a king driving it around, now I feel embarrased because the front end is all crapped up.

I would say go for it! If you have the proof then you will win. Thats what my mom did and she won outright. Do you what you heart tells you to do. Man I feel so sorry for you and I hope soo much that you win you case.

Threaten pain and suffering!! LOL Tell them you hurt your neck, maybe they'll offer a settlement!! It sounds bad but they are refusing to take responsibility, let alone simply help you. It was your fault for crossing the barricade, but it was also their job to take certain precautions and they failed to do so then to top it off, they failed to help?? Oooohh, I would be livid!!
REVENGE WOULD BE MINE!!!!! Sorry, got a little carried away there...

Well... the thing is the only indicator was a sign that said Road Closed Ahead in the middle of the travel lane that you could go around if you wanted. I chose not to and chose a different way to go, up over a dirt road that came onto the road about 1 mile down the road via a side street through a housing development. I didn't see any signs saying road closed ahead from there or anything so I figured I succesfully got "passed" the closed section since there weren't any other warnings or anything. So drove down the road and yea then it happened. I did use my odometer and determined that the Road Closed Ahead sign was 3.9 miles away. Doing research I found that it was suppose to be a maximum of 1500 ft away. So that was a nother mess up. It just sucks, royall sucks. And everyone reply I have is going to be a normal response like this was then at the end say "it just sucks" LOL j/k I won't, but I needed to say it again because it does.

Good luck! Sorry to hear about your new car. You really hate getting that first scratch on your new car. It really sucks wrecking it.

Were you asking me? That was someone else. I remember the post and had some threads in it. I've had mine up to 162 but it was not top end. My top end should be over 175, but I was running out of road and had to let off. My butt had also had all the seat it could eat also. :D

hehehe.... 162 would scare me way tooo much.... all my cars had speed govonors on them.... the highest being 112. That didn't scare me, but I think 130 and up would

:happyfish Oh I am sooo sorry to hear about your new saturn. That sucks. I feel for ya. I got my jeep broken into 2 years ago 1 month after I bought it, and had a 1000$ deductable, and they talleyed up the dammage at the insurance company, and what do ya know the tally came up to 995$. I think that's too much to be a coincidence that it cam up 5$ under the deductable! I hate insurance companies. So, I just ended up fixin everything myself. I went to a bunch of places, and no one would go up against the insurance companie. So, I have a dented back hatch from the crow bar they used, messed up power door locks, they stole a 300$ radio, they ripped my headliner, and cracked apart my cluster guage cover. So I glued the guage backtogether, bought a new radio, sorta fixed the headliner, and still can't figure out what they did to the power door locks. The learning experience was to get a 0 deductable. I pay a little more, but at least I don't have to out 500-2500$ deductable, which I could never afford. Anyways, sorry to hear about your pretty new car, ali:happyfish

dang that really sucks dude.... it sounds like the people had something against you though by cutting the headliner and stuff

:happyfish Ya coulda but it looks like after they had used a crow bar to get in through the hatch, they may have accidentally snagged the headliner with the crow bar, as it was a rip. I don't think they care all that much, they did all this just to get a radio, so now I have one of those radio's that when you turn off the car, or turn off the radio, you can either take it out, or it will flip around, and look like there is no radio there. I don't really have any enomies but ya never know. I had it parked in my driveway with the butt of the jeep towards some woods, so I'll never do that again. Well, I don't live there anymore, so it definately won't. The pisser was that the stupid jeep I had just bought turned out to kinda be a lemon, and I had to spend almost $2 grand just to get it up to shape, when it was only worth 4500 at the time. If you ask me, I think that month I did somethin to offend the big man upstairs if you know what I mean.
So, your not alone brandon, it happens to the best of us. Good luck with your car, and hope you don't have a problem with the insurance company like I did. Mine is State_____ Guess who? Good luck, ali

yea that's my insurance company too. So far they have been nice about it all. They even said they would pursue penndot for me if I wanted since I had pictures and everything I think it made it more feasible for them. Got an estimate today on the car..... $1200 some to fix it. New hood and repair the bumper and such. I called PennDOT back today and I didn't get the mean *ssh*le of a guy this time and the girl actually remembered me calling in 2 days ago. So they are sending me a form to file a complaint. Maybe I'm getting somewhere now... don't know though. If not at least after the deductible my insurance won't go up since the amount minus my deductible is less than 1150 or something like that.
They might have given you a hard time because of the stereo in the car, I know they told me unless I buy additional coverage and provide them with serial #'s of the stereo components in my car they won't cover it.

hey bro it could be worse, i got in an accident late last month and my car has not been registered since last january and i didn't have any insurance, so i am basically looking forward to a good @$$ reaming by the local police. still dont have it registered or insured, maybe this weekend. for any cops reading this, sorry, but i really dont like cops or firefighters or even emt's that much. anyone with a siren and a "playing god" attitude just errrrrrr....... all i am doing it just trying to make a living and keep a roof over my head, ya know?? i get pulled over again and i go to jail fo no insurace. hope not. anyways sorry dude.

I learned the hard way about kids and accidents, Bought my 17 year old son a brand new 2002 chev side step pick up for Christmas in (02). Jan 30 1 month later, he rolled it! $14,000 in damage insurance co. fixed it. but cancelled my son. Bought my daughter a USED 98 convertable mustang for her 16th birthday in june, 3 weeks later she totalled it! insurance co cancelled her too!
One car per kid, It's up to them now!!!! better get a good job cause insurance will kill ya!
