It was obviously an accident although it seems as if he was driving too fast. If he denied it, he obviously is doing other stuff that would be actionable.
His boss asked him after it happened if he had backed the truck up to the door to open it without getting off the truck because she has told him in the past not too. He lied and told her that he didnt even though me and another guy were both there when it happened. She said that people saw him do that and he said that whoever said that was lying. So, I then pulled the security tape to show to his boss that proved he was lying to her. They havent fired him and I can not for the life of me understand why. This is not the first time he's caused damage with the forklift. He just doesnt learn, but the management here also just doesnt do anything about it either. I think he is getting written up, but if it were me, I would have fired him for lying about it, not for the accident itself.
