New Protein Skimmer or MP40? what would you do?

I notice 2 things in this pic......First is the gate valve......It looks like the line is extended underwater 2"-3"......I can tell you that being that deep will cause gurgling/back pressure which will equate to noise.......
The other is the check valve.....False sense of security, and yes people use them, but they do fail, and no one knows exactly when they will, but I'd remove it for 2 reasons....1 cuts down flow from your return pump a bit, and with siphon break holes in place wouldn't be needed.....

I will check and get back to you. My guess would be 15" How about pump size any idea? I still plan on Hard lining once I know what pump to use

Update. I took the skimmer down and found that it had salt creep in the air intake. I remember I did a mod to my ASM 3 5 years ago and drilled out the barb that the air tube connects to, which increased air flow I did a water change hooked it back up with the mod last night and now I have over an 1.5" of skimmate after one day.
Any idea on pump size
