I would follow the advise of the lawyer but the ATF might find it interesting that they confiscated the gun without giving you a reciept. I had a friend that had a handgun confiscated in Alabama under the same cicumstances except it was a traffic stop. They did not give him a reciept and the gun later ended up in a murder case. Luckily there were a hand full of witnesses there when the gun was confiscated

Holy post resurection! I really want to know what happened to this guy, as I had ran in to a similar issue.
We all tried to keep up on this delicate situation. Sadly within a couple weeks of his arraignment rangermonroe was viciously ripped apart by a pack of wild badgers. We will never know how this would have played out.
