From the letter, the officer is not commiting treason, derilection of duty or refusing to follow a lawful command. He is petitioning the court for proof that his Commander-In-Chief is a Constitutionally elected commander. The worst he could get is a reprimand, unless he deserts his post or refuses to follow orders. Both of which, he has not done. I think this will go nowhere. Even if the President was born in Kenya, the registrar for vital statistics has officially acknowledged his American birth. The controversy is moot. I think that if Republicans jump into this, it will be more bad news for them come 2010. Most Americans don't care if he is or isn't native born. I know the Constitution is clear and he might have been born elsewhere, but this is a lose-lose for any Republican who presses the issue. GenX and GenY doesn't care and they voted for him.
