i'm having the day from hell.
sorry for not using the any capitals, but my husband got water on the laptop keyboard and now the shift key doesn't work....
 
anyways,
as many of you know, i recently purchased orange spotted filefish and was planning on going to manhattan aquariums today to pick up some large acropora colonies that i could frag and give to them frag by frag until they are weened. right now is also the san gennara feast down in little italy. my husband and i decided to make the best of our day to the city and went to little italy for lunch and then were going to shoot up town to the fish store, pick up some coral and come home. since the feast is going on right now, there is no parking anywhere on the streets. we decided to use a parking garage, we've never had an issue with one before. drive my car in, drop off the keys, get a ticket, tell them we will be back between 3 and 4, and off we go. had a wonderful lunch.
 
go back to the garage to get our car, they bring us the wrong car twice........
 
then the correct car finally comes up the ramp, guy hands us the guys and walks away quickly, first time someone didn't stick around for a tip....
my husband's little sister goes to walk around the back of the car to the other side and all of a sudden as i'm about to clos the door goes, ''do you see this''. i thought she was joking until i turned and saw the expression on her face...
i get out, walk to where she is and at first all i see is a tail light smashed in. i get angry, but ok, it's a tail light....
she goes, no , come here....
i walk around to the other side wher she is standing and realize the my entire quarter panel is scraped, and then as it reaches the end of the car near th bumper and tail light, it's smashed...
like slammd into a brick column in a parking garage doing 70mph smashed... i have a huge crease, half the tail light is gone, gas door is scraped, bumper is hanging and smashed. i flipped
 
the manager comes out and of course, first he insists that it was like that when it came in. uhm, no dude. i have my sister in law call the cops. he gets mad and argues with me not to, of course, i did anyways, and magically his english isn't so great anymore. funny how that works sometims

has me fill out a claim report sheet for their company and argues with me about what damage i can write down, insisting that scrapes were there bforehand. i yelled at him and told him that the claims adjuster could be th one to decide that. in all this, he still thinks that i should have to pay for parking
ummm, no. i'm not paying 32 dollars for my car to come back smashed. it was there for 2 hours.....
 
cops come and make him give me back the form to fill out more damage.
 
so we go to drive the car home and my husband gets on the manhattan bridge and says, ''call the insurance company back, they hit the car so hard that the suspension is screwed up and the car is pulling'' yes, that's how hard they crashed the car... husband is a mechanic and has already given a rough estimate/idea. the suspension is bad, so the frame might be bent as well, and the quarter panel is dented and creased. when all is said and down i'm looking at a minimum, and this is a big minimum 6 grand in damage before paint.
 
i know i'm going to get screwed here. my insuranc is telling me that more than likely i'll have to pay a deductible and then they'll fix it and then they'll go after the parking garage for money. this seems weird to me, wouldn't they want the money first. why do i have to pay for something that was not my fault, especially when we know who is at fault.

Unless the garage wants to step up and cover the damages you can either live with it until your insurance settles up with them or pay the deductible. What really sucks is it counts as a claim against your policy unless the garage pays the claim.

that's my big issue. we own 3 cars, live in new york, and my husband has a bad driving record, so we pay a lot for insurance already.
 
i have to get it repaired, theirs a lein on the car and it's not driveable and i use this car for work.
 
i'm going to fight with them to total out the car because my resale value is gone now. the whole reason i purchased a honda was for resale value. and to think, i was trading this car in next month

luckily the garage finally did give me a report. i just have a bad feeling that it's going to take forever if i see any money out of them. this is also what my insuranc company told me.

On another note if that dent has affected the way the car drives it's time for a new car. That isn't that hard of a hit if the trunk lid and rear door panel still align.

my thoughts exactly.
 
the trunk won't open properly though. and it doesn't show up on the pics well, but from the rear door back is scraped, i think after they hit, as they pulled away, it scraped more. but the car pulls insanely hard, the suspension is a mess, if it hit hard enough to mess with the suspension, i don't want the car anymore.
it hit hard enough to throw things inside my car and trunk [a bowling ball, actually]. they didn't have the key to the trunk and i locked them out so i know it wasn't just them digging around for stuff.

btw, the bumper was off, my husband slammed it back on just to get it home and the rim is all scraped and scuffed

OMG!!!! And my husband wonders why I never let anyone touch my car....LOL...I had this happen to my in NY once....at a dealer no less.....Brought a car in to be looked at..only had it a month...my ex and I went to pick it up, and it had a big gash down the side
....apparently they had a piece of their chain link fence sticking out....well the guy tried to say it was like that and he even called me a liar.....well my ex physically went after the guy (YUP...another reason he's the ex) and when management came out, we got it taken care of, and they fixed it.
 
Sorry for your troubles.....I will tell you this though...I use State Farm Insurance...since being in Oklahoma I have had 2 totaled cars....ONE I was run off the road by an unlicensed, uninsured vehicle....my insurance company paid in full NO EFFECT TO ME

My insurance has NEVER gone up...these were accidents that were not my fault, and I was not penalized. I realize some insurance company's will penalize you, but IMO, Look for the ones that don't

this is one of the things that sucks about ny...people are just jerks sometimes.
 
i was hit by an unlicensed, uninsured driver a couple years ago, it went on my record as no fault, but my insurance [geico] went up and i've been paying more money since it happened. they claim that since they never found the other driver, and since there was a significant pay out, my premium would have to be hit for 5 years. i still am angry about this, i have a police report and three witnesses that say it wasn't my fault in any way, and yet i still have to pay for it. lovely. i feel like that's what's going to happen this time. the parking garage was so rude, and what a surprice, the number i was given and told to call to speak to someone about insurance, yeah, it's disconnected

Wow!! Man they sure was hoping you would leave before noticing their mistake for sure. I think you were lucky to have your husband's sister with you that day or else you might not have noticed it until it was too late.

Not sure the damage to the car that's pictured, is causing the car to pull severely to the left. IMHO, it really looks like your car was the one moving when it hit something, and going in reverse (how those scratch marks go forward, then loop back). Whoever was driving might have clipped or completely drove over a curb, sending the car into the wall/pole. Take a look at all 4 wheels and see if there's any new marks or damage to any of the other wheels.

Unless they marked the car had damage on the claim ticket they are going to have a hard time fighting this.

Oh man I know people can be jerks, but the gall to stand toe to toe in your face and insist it was there already...and act all mad about it...knowing full well what really happened. I could never pull it off. Guilt would be all over my face.
 
That may be why the driver slinked away so fast. Not only was the car damaged but he knew his company would want him, whether he did it or just knew about it..to deny it like a lying dog...it takes a certain kind of low life to be like that...I wouldn't have to be really hungry to work for such a place.

I couldn't do it either. I know people that would, though. And it goes both ways...I know people that would use the opportunity to blame someone else for damage that was already there. We live in a sad, sad world.
